Adjoining Owner Surveyors

 

Roles and Responsibilities


Appointment as the Adjoining Owner’s Surveyor only. Where an Adjoining Owner wishes to appoint their own Surveyor under section 10 (1) of the Party wall etc. Act 1996 (the Act). The Building Owner has made an appointment of a surveyor also under the Act.

 

Reviewing original Notices, accompanying section drawings, structural calculations to verify their validity. Reject Notices if invalid.
 

Exchange with Building Owner’s Surveyor to select a competent third Surveyor under section 10 (1) (b) of the Act.
Be present to record a schedule a condition with the Building Owners surveyor.


Negotiating a fair Party Wall Award(s) with the Builder Owner’s Surveyor to include reasonable fees
Issuing and serve the Party Wall Awards to the Adjoining Owners.

 

Once works have been completed check off the schedule of condition where required


Should any damages occur a further Award to be issued to account for costs, fees and damage.

The reasonable fees are provided by the Building Owner.

 

Normally, extra charges are incurred at an hourly rate over and above the original fee.

The process starts with the service of Notices.

It should be noted that if notices served do not contain all of the necessary information, for example the excavation location and depth of any proposed foundation they will be deemed invalid and the process shall have to recommence. Our expert Certified Party wall surveyors pay attention at this stage always following Royal Institute of Chartered Surveyors (RICS) best practice where possible.

 

The Award

 

This legal document is initially raised by the Building Owners surveyor and checked and updated by the Adjoining Owners surveyor. In complex situations such as basement excavations the Adjoining Owners surveyor may appoint his own checking Engineer who is a qualified structural Engineer to check and confirm the calculations undertaken by the Building Owners structural surveyor are indeed accurate and correct. The Building Owner is once again responsible for these additional fees. Once the Award is agreed its published under the Party wall etc. Act 1996 (Electronic Communications) Order 2016.

 

Our Frees as Adjoining Owners surveyor

 

When appointed as the Adjoining Owners surveyor we will not charge the Adjoining Owner any frees whatsoever are services are fee and provided for by the Building Owner.

 

We can charge a fixed fee or an hourly rate depending on the circumstances.
